windows compilation bug

a number of CI builds have been failing on github actions on the windows builds only, I thought I saw a pattern with python 3.8 being the culprit but it appears that it can vary python version. This may also be why builds for #410 are failing.

I don't know what could be happening but likely something with the compiler has changed in the -latest workers
